How residency is computed

FEMA (Foreign Exchange Management Act)

You are an NRI under FEMA if you stay in India for less than 182 days in a financial year (April 1 – March 31). Affects: NRE/NRO accounts, repatriation rights, and overseas asset reporting to RBI.

Income Tax Act — Section 6

You are a Resident if you stay ≥ 182 days this FY, OR ≥ 60 days this FY + ≥ 365 days in the preceding 4 FYs. RNOR status provides transitional relief — foreign income is not taxable for 2–3 years.

⚠️ FEMA and Income Tax Act use different rules. You can be an NRI under IT but a Resident under FEMA — or vice versa. Always verify your exact status with a qualified CA before filing taxes or making large financial decisions.
