Form 10F & TRC — Complete Guide for NRIs (2025-26)
If you receive income from India — NRO interest, rent, property sale proceeds, or dividends — your bank or payer must deduct TDS. To get the reduced DTAA rate instead of the 30% default, you need two documents: a Tax Residency Certificate (TRC) from your country of residence, and Form 10F filed on the Indian IT portal. Both together direct the payer to apply the treaty rate.
TRC: country by country
Every country's tax authority has a different process. The Netherlands takes 2–4 weeks and issues online via Belastingdienst. The USA is the slowest — the IRS Form 6166 process takes 6–8 weeks and costs $85. Singapore's IRAS is fastest — typically 3–5 business days via myTax Portal. Germany requires a written request to the local Finanzamt. This tool shows you exactly what to do for each country so you don't lose time looking it up.
Form 10F: what changed in 2022
Until 2022, Form 10F was a paper form submitted to the Indian payer. From June 2022 (with a brief relaxation period), the Income Tax department mandated online filing on the IT e-portal (incometax.gov.in). This requires the NRI to have a PAN and register on the portal — many NRIs missed this step and received full 30% TDS deductions as a result.
The form itself contains: your name, PAN, address in India and abroad, nationality, country of residence, tax identification number in the residence country, period of residency, and whether a TRC has been obtained. Once submitted, you receive an acknowledgement that you share with your Indian bank or payer.
Annual renewal cycle
Both TRC and Form 10F are valid for one Indian financial year (April–March). You need to renew every year. The recommended timeline: apply for TRC in January (3 months before FY end), so you have it ready for the new April–March cycle. File Form 10F online immediately after. Submit both to your Indian bank by April 1 each year to ensure the reduced rate applies to the full year's income.
Frequently Asked Questions
What is Form 10F and when does an NRI need to file it?
Form 10F is a self-declaration form under Section 90/90A of the Income Tax Act. An NRI needs to file it when claiming DTAA benefits in India — typically to get reduced TDS on NRO interest, rental income, or dividends. It is required when the Tax Residency Certificate (TRC) from the residence country does not contain all the information required under the Indian tax rules, or when the TRC has not yet been obtained.
What is a Tax Residency Certificate (TRC) and who issues it?
A TRC is an official certificate from your country of residence's tax authority confirming that you are a tax resident there. In India, it is mandatory for claiming reduced TDS rates under DTAA. Each country has its own authority: Netherlands (Belastingdienst), UK (HMRC), Germany (Finanzamt), USA (IRS Form 6166), Singapore (IRAS), etc. This tool shows the exact procedure for each country.
How long does a TRC remain valid for India DTAA purposes?
A TRC is valid for one Indian financial year (April 1 to March 31). You need to obtain a fresh TRC for each new financial year if you continue to receive Indian income. The TRC must be submitted to your Indian bank or payer before the reduced TDS rate is applied — ideally at the start of the financial year.
Where do I submit Form 10F in India?
Form 10F must be filed online on the Income Tax e-filing portal (incometax.gov.in) — since 2022, paper submission is no longer accepted. Log in with your PAN, navigate to 'e-File → Income Tax Forms → File Income Tax Forms', select Form 10F, and submit. Once filed, download the acknowledgement and share it with your Indian bank or payer along with your TRC.
Can I claim DTAA benefits without a TRC if Form 10F is filed?
Yes, partially. Form 10F was specifically introduced as a substitute when the TRC does not contain all required information. However, payers (banks, companies) may still require some form of TRC. From June 2023, filing Form 10F online on the IT portal is mandatory for NRIs. Consult your Indian CA to confirm whether your payer accepts Form 10F alone or also needs the TRC.
